共同富裕的宪法共识:代际对话与规范内涵

摘　　要：“共同富裕”表述并未出现在我国现行《宪法》文本中,但社会主义原则以及政治、经济、法治等多个维度的宪法规范共同构成共同富裕理想的规范基础。在宪法层面阐发共同富裕的规范内涵,有赖于在代际互动过程中把握其延续性和变革性。代际延续性蕴含着宪法规范内涵相对稳定的基本内核,代际变革性则为宪法规范内涵赋予相应的时代意蕴。在迈向共同富裕理想的新阶段,应当以《宪法》作为根本依据,理解历史过程、回应现实问题,把握共同富裕的体制逻辑。在具体阐述中,根据时代条件阐释并维护按劳分配主体地位、充分发挥各种所有制经济的积极作用、普遍提升社会成员参与经济发展的内在动力与实际能力、尊重并保护合法的私有财产等应当构成宪法共识规范命令的主要内容。形成有关共同富裕的宪法共识,有助于消除不恰当或模糊的认知,引导社会成员形成合理且稳定的财富预期,为推动共同富裕提供现实空间与合宪方案。The expression“Common Economic Prosperity”does not appear in the text of our current Constitution,but the principle of socialism and the constitutional norms of politics,economy and rule of law together constitute the normative foundation of the ideal of common economic prosperity.Explaining the normative connotation of common economic prosperity at the constitutional level depends on grasping its continuity and transformation of intergenerational interaction.Intergenerational continuity implies a relatively stable key component of constitutional normative connotation,while intergenerational transformation gives a corresponding contemporary meaning to constitutional normative connotation.In the current stage of moving towards the ideal of common economic prosperity,the Constitution should be used as the fundamental basis for understanding the historical process,responding to real problems and grasping the institutional logic of common economic prosperity.That requires explaining and upholding the status of the mainstay of distribution according to labor,giving full play to the positive roles of all kinds of ownership,generally enhancing the intrinsic motivation and practical ability of the members of the society to participate in economic development,and respecting and protecting the lawful private property.The formation of a constitutional consensus on common economic prosperity can help eliminate inappropriate or ambiguous perceptions,guide members of society to form reasonable and stable wealth expectations,and provide realistic space and constitutional solutions for the promotion of common economic prosperity.
