过滤义务域外规则走向对我国版权立法的启示

摘　　要：【目的】分析欧盟的版权改革方案背后的立法逻辑,为我国今后版权立法引入过滤义务提供启发。【方法】以网络服务提供者版权过滤义务为研究对象,梳理其规则变动的国际走向,以比较法的视野分析并总结欧盟版权改革指令存在的问题。【结果】欧盟版权改革指令对避风港规则进行开创性的突破,但其立法框架内部问题及法律实效问题不容忽视。【结论】我国在未来的版权立法中要转变立法理念,包括注意立法与技术衔接,纠正对过滤义务性质的错误认知,平衡各方利益。同时,通过设置过滤标准差别性应对机制和完善事后救济措施,以细化制度安排。[Purposes]In order to make up for the shortcomings of meteorological observation business caused by single detection means and limited meteorological data,the ground-based remote sensing vertical observation system under construction is studied.[Methods]By analyzing the composition and principle of the ground-based remote sensing vertical observation system,as well as its practical application in business,the specific performance of the system for meteorological process research and early warning was explored.[Findings]The construction and application of the ground-based remote sensing vertical observation system made up for the shortcomings of meteorological detection to some extent.Abundant and accurate meteorological data were provided whether in daily weather forecast or in special weather meteorological detection,which provided strong data support for meteorological monitoring,early warning and weather process inversion.[Conclusions]The ground-based remote sensing vertical observation system provides strong support for fine weather forecasting and weather modification operations.
