从分散化转向集中化:我国体育赛事知识产权立法模式考量

摘　　要：我国目前的体育赛事知识产权保护适用的法律较为分散,具体表现在法律渊源层次的分散和保护对象的分散,这一模式不仅存在大量的立法漏洞和冲突,法律法规的局限性和时效性还会产生高昂的成本。究其原因是分散化的保护模式与体育赛事知识产权的内在特点相违背。为使我国体育赛事知识产权得到周密性、高效性的保护,须逐步构建一个与体育赛事知识产权本身特点相契合的集中化立法体系。基于立法成本、立法适用等现实因素的考量,我国应首先确立相对集中的体育赛事知识产权立法思路,进而逐步构建集中化立法模式。The current legislative mode of sports events intellectual property protection in China is decentralized,which is manifested in the decentralization of its legal origins and the dispersion of its protection objects.This mode not only has a large number of legislative loopholes and conflicts,but also would incur high costs due to the legislative limitations and timeliness.The reason is that the decentralized protection mode is contrary to the inherent characteristics of sports events intellectual property.In order to protect the intellectual property of China’s sports events,it is necessary to gradually build a centralized legislative system that is compatible with the characteristics of sports events intellectual property.Based on the consideration of realistic factors such as legislative costs and legislative applicability,China should first establish a centralized legislative approach to sports events intellectual property protection and further construct a centralized intellectual property legislative mode for sports events.
