摘　　要：院庭长办案制度的常态化运行对提升审判组织办案质效、缓解基层法院人案矛盾具有重要的理论价值和实践意义。实证研究表明,当前法院院庭长办案虽然已实现“制度化”,但院庭长入额比例高且办理的案件以参审案件、简单案件为主,其带来的直接后果是加剧了基层法院的人案矛盾。究其根源,客观方面表现为,院庭长办案制度考核标准有待细化、院庭长分案机制有待完善和缺乏刚性的监督机制;主观方面表现为,院庭长没时间办案、不敢办案和不重视办案。因此,基层法院为缓解人案矛盾,亟须建立系统性、可操作性的院庭长办案长效机制。以院庭长办案制度为视角审视当前基层法院面临的人案矛盾,旨在为我国基层法院推动员额制改革、推动审判权运行机制改革以及优化司法资源,缓解人案矛盾提供新思路。The normalized operation of the system of case handling by director and chief judge of the court has important theoretical value and practical significance to improve the quality and efficiency of trial organizations and alleviate the contradiction between personnel and cases in China's grassroots courts.Empirical research shows that,despite the current“institutionalized”case handling by director and chief judge of the court,they have a high proportion of posts and focus more on trial participation and simple cases.The direct consequence is to aggravate the contradiction between personnel and cases.At its root,the objective aspects are manifested in the need for the refinement of evaluation criteria for system of case handling by director and chief judge,the improvement of the allocation system of cases to the director and chief judge of the court,and the lack of a rigid supervision mechanism;subjectively,it is manifested by the lack of time for case handling by director and chief judge,reluctance to handle cases,and a lack of emphasis on case handling.Therefore,in order to alleviate the contradiction between personnel and cases,the grassroots courts urgently need to establish a systematic and operable long-term mechanism of case handling by director and chief judge.The purpose of this study is to provide new ideas for China's grassroots courts to promote the reform of the post system,the reform of the trial power operation mechanism,and the optimization of judicial resources,so as to alleviate the contradiction between personnel and cases.
