代孕的伦理思考与社会规制

摘　　要：代孕是一种人类辅助生殖技术新的延伸,自诞生起就在伦理学界和法学界引发了巨大争议。为了保障社会的和谐发展和正确引导人们的需求,本文试分析了代孕会引发何种伦理问题。目前,社会各界针对代孕有两种声音:一种是允许合法化,另一种是禁止合法化。立足于伦理与法律的关系,代孕在伦理上引发的问题值得思考,在法律上却是不合规范的。因此,通过代孕与生育权、生命权和自由权等公民基本权利实现问题,本文认为代孕应该被禁止。根据我国实际情况,应坚持禁止代孕的态度和严厉打击代孕现象,维护现有的社会秩序和法律规则。Surrogacy is a new extension of human assisted reproductive technology,which has caused great controversy in the ethical and legal fields since its inception.In order to ensure the harmonious development of society and correctly guide people’s needs,this article analyzes the ethical issues that surrogacy can cause.At present,there are two voices in various sectors of society regarding surrogacy:One is to allow legalization,and the other is to prohibit legalization.Based on the relationship between ethics and law,the ethical issues raised by surrogacy are worth considering and are also non-standard in law.Through the realization of basic rights of citizens such as surrogacy and reproductive rights,life rights,and freedom,it is believed that surrogacy should be prohibited.Based on the actual situation in our country,we will adhere to the attitude of prohibiting surrogacy and crack down on the phenomenon of surrogacy,while maintaining the existing social order and legal rules.
