我国古代“恤刑”主义思想及其对当代刑事政策的启示

摘　　要：我国古代法律制度中,“恤刑”主义思想及其制度具有难得的人文主义精神。当代刑事政策可汲取“恤刑”制度的优点,在刑事政策制定中注意“情理法”三者融合,发挥刑事政策对于司法实务的调节作用,通过刑事政策引导加强非监禁刑的运用,共同助推我国社会主义法治国家建设。In the ancient legal system of our country,the thought of“compensation for punishment”and its system have a rare spirit of humanism.Contemporary criminal policy should thoroughly absorb the advantages of the“compensation for punishment”system,pay attention to the integration of“emotion,reason and law”in the formulation of criminal policy,develop the regulatory role of criminal policy in judicial practice,strengthen the use of non-custodial punishment through the guidance of criminal policy,and jointly promote the construction of a socialist country ruled by law in China.
