中国式“能动司法”的诠释与分析

摘　　要：能动司法是一种现代司法概念,其内涵是司法权以何种方式运行。我国司法能动的具体实践与域外司法相比较,存在一定的共通性与明显的差异性。司法权是否能动以及如何能动,存在着不同国情与国情赋予条件的问题。能动司法有着明确的价值取向与功能设定,它是针对特定司法事项或者领域提出的口号,不等于否定司法克制的价值,否则必然模糊司法与立法、行政不同的权力属性。我国司法机关提出“能动司法”的口号并加以贯彻落实,这是对自身履行职能方式重新认识的结果,也是国家与社会发展到一定阶段的产物。我国司法机关需要从本国司法自我塑造的构想及国情提供的实际条件出发,选择设定积极、主动的司法权运行方式,掌握好司法积极作为的目标和界限,以求取得司法能动的预期功效,满足国家与社会发展对于司法权的最新要求。Active judiciary is a modern judicial concept,which has the connotation of how judicial power operates.Compared with other nations,active judiciary in China has certain commonalities and obvious differences.As for whether and how judicial power is active,there is a problem of conditions given by different national conditions.Active judiciary has a clear value orientation and function setting.It is a slogan put forward for specific judicial matters or fields,but not the wholly denial of the value of judicial restraints,otherwise the delineations of power attributes of the judiciary,legislature and administration will be inevitably blurred.The judicial organs of our country have raised the slogan of"active judiciary"and implemented it,which is the result of a new understanding of the way they perform their functions,and the product of a certain stage of the development of the country and society as well.Starting from the concept of judicial self-shaping and the actual conditions provided by the national conditions,the judicial organs in China need to set a positive and active judicial power operation mode,and grasp the goals and boundaries of judicial active action,so as to obtain the expected effect of judicial activity and meet the latest requirements for judicial power from the development of the country and society.
