知识产权司法保护与出口技术复杂度——兼论“双轨制”下知识产权行政保护的调节效应

摘　　要：本文基于2005—2018年城市面板数据,运用非线性关系检验模型实证研究了知识产权司法保护影响出口技术复杂度的理论机理及其背后的作用机制,解析了“双轨制”下知识产权行政保护制度、数字经济与市场活力在这一过程中的调节效应和中介效应。研究发现:知识产权司法保护与出口技术复杂度呈U型关系,且这种关系具有显著的出口科技含量、区域和时期等异质性;“双轨制”下知识产权行政保护会增强知识产权司法保护对出口技术复杂度的影响效应;知识产权司法保护通过促进数字经济发展和激发市场活力来促进出口技术复杂度的提升。Base on the urban panel data from 2005 to 2018, this paper empirically studied the theoretical mechanism and the mechanism behind the impact of judicial protection of intellectual property on the technical complexity of export technology by using the nonlinear relationship test mode, meanwhile respectively analyzed the moderating effect of administrative protection system of intellectual property and intermediary effect of digital economy and market vitality under the “dual track system”. The results show that the judicial protection system of intellectual property has a U-shaped relationship with the export technology complexity with a significant heterogeneity of export scientific and technological content, region and period. Administrative protection system of intellectual property will enhance the impact of judicial protection system of intellectual property on the export technology complexity, while judicial protection system of intellectual property can ultimately increase the export technology complexity by developing the digital economy and stimulating market vitality.
