长三角区域公平竞争审查监督机制的困境检视与优化进路

摘　　要：长三角区域目前采取了内外结合的公平竞争审查监督方式,但内部监督自我约束与府际竞争引发的控权失灵使其存在较大的局限性,内部监督的标准、频次及结果回应也亟待明确。此外,反垄断执法与联席会议的外部监督缺乏刚性约束作用,公众投诉举报机制亟待解决实体和程序缺陷。这些问题的出现与长三角区域特殊的法治、经济、文化环境有关,应在深入分析现存问题的基础上,有针对性地对监督机制进行优化。在内部监督方面,应增进内部监督主体开展政策评估的内在动力,加强标准建设,妥当确立程序治理的基本范式,保障评估结果的有效利用。在外部监督方面,应构建长三角区域投诉反馈回应机制,通过人大立法监督提升公平竞争审查的权威与效用,完善公平竞争司法审查机制。Currently,the Yangtze River Delta region adopts a combination of internal and external fair competition review supervision,but the self-restraint of internal supervision and the failure of control caused by inter-governmental competition make it more limited,and the standards,frequency and response to results of internal supervision need to be clarified.Moreover,the external supervision of anti-monopoly enforcement and joint meetings lacks rigidity and constraints,and the public complaint and reporting mechanism urgently needs to address substantive and procedural deficiencies.The emergence of these problems is related to the special rule of law,economic and cultural environment of the Yangtze River Delta region,and the monitoring mechanism should be optimized in a targeted manner based on an in-depth analysis of the existing problems.In terms of internal supervision,the internal supervisory bodies should be motivated to carry out policy evaluations,standards should be strengthened,the basic paradigm of procedural governance should be properly established,and the effective use of evaluation results should be guaranteed.In terms of external supervision,a feedback and response mechanism for complaints in the Yangtze River Delta region should be established,the authority and effectiveness of the fair competition review should be enhanced through legislative supervision by the National People's Congress(NPC),and the judicial review mechanism for fair competition should be improved.
