摘　　要：社会信用制度建设之初的目的是为了缓解经济信用危机,而后在国家出台实施了一系列规划与政策的推进下,依托多种信用平台逐渐发展为一项全面的法律制度。20多年来,社会信用制度促进了社会主义核心价值观的践行,重塑了社会诚信风尚,但在全面推进依法治国的新时代,其也存在定义模糊、发展不均、惩戒偏颇等问题。作为新型治理工具的社会信用制度应立足法治国家、法治政府、法治社会一体建设视角,以信任机制规范社会公众行为、以公众监督完善权力制约机制、以政社协同促成多元主体共治。社会信用制度中政务诚信、商务诚信、社会诚信和司法公信应相辅相成,共同推进。除弥补统一信用立法的缺失、平衡信用监管和信用服务外,还需要激发市场活力以保障该制度行稳致远。The social credit system was initially built to alleviate the economic credit crisis.Later,under the promotion of a series of plans and policies introduced by the state,it gradually developed into a comprehensive legal system relying on a variety of credit platforms.In the past twenty years,the social credit system has promoted the practice of core socialist values and reshaped the trend of social integrity.While in the new era of law-based governance on all fronts,it also has problems such as confusing definition,uneven development,and biased punishment.The social credit system,as a new type of governance tool,should be based on the perspective of the integrated construction under the law-based country,government and society.It also should standardize social public behavior with the trust mechanism,improve the power restriction mechanism with public supervision,and promote the co-governance of multiple subjects with political and social coordination.In the social credit system,government integrity,business integrity,social integrity and judicial integrity should complement each other and promote together.In addition to compensating for the lack of unified credit legislation,balancing credit supervision and credit services,it is also necessary to stimulate market vitality to ensure the stability and long-term development of the system.
