行政处罚决定公开的现状、问题与对策——以浙江政务服务网公开“行政处罚结果信息”为分析对象

摘　　要：从浙江政务服务网公开的行政处罚结果信息来看,存在着公开实践与法律、行政法规的规定不完全相符合、公开形式不一致等问题。而这些问题出现的一项关键原因是公开的责任主体即行政机关对行政处罚决定公开的功能没有清醒、足够的认知。为了解决这些问题,应该在坚持公益和私益各自最优化的原则基础上,采取如下三项措施:一是只能公开具有一定社会影响的处罚决定,不宜采取全部公开的策略;二是在公开形式上,应采取全文公开形式,不宜摘要式公开;三是应对涉及个人隐私等因公开容易受到伤害的合法权益信息作出技术性处理。此外,可以从行政处罚所涉领域或事项以及适用程序等方面对“一定社会影响”标准作一具体的、可操作性的设计。Judging from the information of administrative penalty results disclosed by Zhejiang Government Affairs service network,there exists problems,such as incomplete conformity between the public practice and the provisions of laws and administrative regulations,and inconsistency in the form of openness.One of the key reasons for these problems is that the administrative organs,have no clear and sufficient cognition of the function of information disclosure of administrative punishment decisions.In order to solve these problems,the following three measures should be taken on the basis of the principle of the optimization of public and private interests:firstly,only the punishment decisions with certain social impact should be made public;secondly,in the form of openness we should adopt the form of full text rather than briefing summary;thirdly,technical treatment should be made to information about the legitimate rights and interests that are vulnerable due to disclosure of personal privacy.In addition,the standard of"certain social impact"can be designed concretely and operationally from the aspects of the fields or matters involved in administrative punishment and applicable procedures.
