刑罚教育功能视角下我国环境犯罪立法完善探析

摘　　要：中国式现代化是人与自然和谐共生的现代化,织严织密生态环境保护法律制度网,用最严格的制度、最严密的法治保护生态环境,在刑事法治领域重视刑罚教育功能在环境犯罪中的实现,是实现中国式现代化的必然要求。历史上人们对“作为国家对犯罪人施加的一种严厉制裁措施”的刑罚是否具有教育功能存在不同的认识,但教育刑论是与报应刑论、目的刑论等诸多学说可以等量齐观的一种学说。刑罚教育功能不仅体现在立法中,也反映在司法上,不仅作用于犯罪人本人,也作用于潜在犯罪人和一般人群。就我国目前环境犯罪立法来看,实现刑罚教育功能还存在忽视生态法益保护、结果犯多、行为犯和危险犯少、未明确规定资格刑等不足,建议今后在环境刑事立法中强化财产刑的适用、健全资格刑的规定、完善管制刑的运用。The Chinese path to modernization is the modernization of harmonious coexistence between man and nature.t To realize the modernization,it is compulsory to build a rigid network of legal systems for ecological environment protection,and attach importance to the realization of penal education's function in environmental crime.Historically,there have been different understandings on whether the punishment"as a severe sanction measure imposed by the state on criminals"has educational functions or not,but the educational punishment theory can be equated with many theories such as retributive punishment and purposive punishment.The function of penal education is not only reflected in legislation,but also in the judiciary.lIt affects the offenders,potential offenders,and the general public.From the perspective of current China's environmental crime legislation in China,there are still limitations in achieving the function of penal education,such as neglecting the protection of ecological legal interests,the increasing number of consequential crimes and descending number of conduct and dangerous crimes,as well as ambiguous defining qualification penalties.It is recommended that the future environmental crime legislation should strengthen the application of property-based punishment,improve the provisions of qualification penalties,and the application of control penalties.
