摘  要:清代京畿地区旗地佃权与典权独立的进入地权交易市场,旗人出租土地获得未来收益的保障,并逐渐演变出押租制。佃户获得旗地使用权后,通过押租使权利不断扩大,在预付押金的情况下取得旗地的用益物权。押租额最大化时,旗地由佃转典,旗人获得当前收益而转让土地物权。旗地佃与典,不同于以往自耕农最优论,也没有完全遵循市场交易规则,是官府控制下的交易尝试,实现了旗地收益的跨期调剂和生产要素的优化配置,也进一步促进了京畿地区土地交易的多样化。In the Qing Dynasty,the tenancy rights and pawning rights of banner land in the capital region entered the land rights trading market independently.Bannermen obtained the guarantee of future income by renting out land,which gradually evolved into the rent deposit system.After obtaining the right to use the banner land,the tenants continued to expand their rights by depositing rent and obtaining the usufruct of the banner land under the condition of paying a deposit in advance.When the rent amount was maximized,the banner land began to be transferred from tenancy to pawning,and the bannermen got the current income and transferred the real rights of the land.The tenancy rights and pawning rights of banner land differed from the previous theory about self-cultivating farmers,and they did not fully follow the market transaction rules,which were trading attempts under the control of the Qing government.They realized the intertemporal adjustment of banner land income and the allocation of production factors.Further,they promoted the diversification of land transactions in the capital region.
