摘　　要：净矿出让是我国矿产资源有偿使用过程中的一项重大制度创新。从2019年全国试点以来,各地积极探索创新工作体制机制、优化行政审批流程、做好矿业权用地用林等要素保障、强化全过程信用监管、完善矿业权所在地群众收入分配方式,成为落实和深化国家“放管服”改革的重要举措,又是服务矿产资源管理的具体抓手。本文通过政策梳理和问题分析,总结净矿出让流程,分析当前用地要素保障问题,提出优化矿产处置、用地保障与监督管理建议。认为“净矿”出让制度模式是理清市场与政府公共服务的边界;应推进各类规划、政策的融合与衔接,统筹矿业权选址与布局;应兼顾各方利益,助力乡村振兴;兼顾矿产、土地资源全周期的综合利用与保护模式。探索和推进采矿权净矿出让制度改革,建立采矿权、土地使用权明晰的产权制度,以维护全民所有资源资产权益,处理好自然资源资产的合理利用与保护的各种矛盾和问题。Net Mine Transfer is a major innovationg of minging right transfer system in China.From the perspective of the national pilot since 2019,local governments are actively exploring and innovating in terms of institutional mechanisms,optimizing administrative approval processes,ensuring factors such as land use for mining rights and forests,strengthening credit supervision throughout the whole process,and income distribution methods for the people where mining rights are located.It is not only in response to the national measures to deepen the reform of“release,management,and service”,but also to give full play to the decisive role of the market in allocating resources,and it is the specific starting point for establishing a service-oriented government in the field of mineral resources management.Through the research method of combining policy combing and problem analysis,this paper summarizes the transfer process of net mine of mining rights,analyzes the land security problems in the transfer of“two rights net mine”under the current land use policy,and puts forward suggestions on optimizing mineral disposal,land security and supervision and management.First,the“net mine”transfer system model is to clarify the boundary between the market and government public services;The second is to promote the integration and cohesion of various plans and policies,and coordinate the location and layout of mining rights;Third,the interests of all parties should be taken into account to help rural revitalization;The fourth is the comprehensive utilization and protection mode of mineral and land resources in the whole cycle.Exploring and promoting the reform of the net mine transfer system for mining rights and establishing a clear property rights system for mining rights and land use rights will help safeguard the rights and interests of all people in resource assets and resolve various contradictions and problems in the rational utilization and protection of natural resource assets.
