摘　　要：随着我国知识产权工作进入新发展阶段,企业高价值发明专利的培育成为备受关注的话题。本文在比较分析当前国内相关研究基础上,从市场价值角度切入,对高价值发明专利的定义和内涵进行了新的界定,提出经过市场检验的发明专利才有可能成为高价值发明专利。同时,研究了高质量发明专利和高价值发明专利之间的辩证关系,提出了高价值发明专利培育的可行路径,并从代理机构、优先审查、非正常专利申请等三个方面对可能存在的问题进行了分析。Along with China’s intellectual property protection has entered a new stage of development,the cultivation of high-value invention patents has become a topic that attracts concerns of enterprises.On the basis of comparative analysis of the current domestic research,this paper makes a new definition and connotation of high-value invention patents from the perspective of enterprise operation,and points out that only the invention patents tested by the market can potentially become high-value invention patents.At the same time,the dialectical relationship between high-quality invention patent and high-value invention patent is investigated.Then the feasible cultivation approaches of high-value invention patent are proposed,and the possible problems are analyzed from three aspects,including agency,priority examination and abnormal patent application.
