我国体育仲裁制度的构造思考——以《体育法》新修订为契机

摘　　要：体育仲裁是解决体育纠纷的重要方式。《体育法》新修订后,明确建立体育仲裁制度。借鉴参考国外仲裁机构设立和管辖范围,不断完善优化我国体育仲裁委员会、体育仲裁院、体育仲裁庭等组织的构造。同时,进一步细化明确我国体育仲裁管辖范围,建议采取肯定性列举和否定性列举2种方式予以明确,从而有效地发挥我国体育仲裁解决纠纷的重要作用。Sports arbitration is an important way to solve sports disputes.After the new revision of the Sports Law,the sports arbitration system is clearly established.By referring to the establishment and jurisdiction of foreign arbitration institutions,we will constantly improve and optimize the structure of China's Sports Arbitration Commission,Sports Arbitration Court,Sports Tribunal and other organizations.At the same time,further refining the scope of jurisdiction of sports arbitration,the positive enumeration and negative enumeration of two ways to be clear,so as to effectively play an important role in our sports arbitration dispute settlement.
