摘　　要：随着大数据技术的持续突破,人工智能成为推动科技跨越发展、产业优化升级、生产力整体提升的重要驱动力量。与此同时,传统法律制度的不足与人工智能人格规制的缺位产生了激烈的冲突,诸如侵权责任纠纷、知识产权归属不明、社会治理困难等问题一直难以得到有效解决。因此,应树立开放发展的理念,推动人工智能法律人格的确立,探索人工智能发展与法律革新的和谐关系。With the continuous breakthrough of big data technology,artificial intelligence has become an important driving force to promote the leapfrog development of science and technology,industrial optimization and upgrading,and the overall improvement of productivity.At the same time,the inadequacies of the traditional legal system and the absence of artificial intelligence personality regulation have produced fierce conflicts,and problems such as infringement liability disputes,unclear ownership of intellectual property rights,and social governance difficulties have been difficult to be effectively solved.Therefore,we should establish the concept of open development,promote the establishment of legal personality of artificial intelligence,and explore the harmonious relationship between the development of artificial intelligence and legal innovation.
