摘  要:农村集体经营性建设用地是我国农村建设用地的重要组成部分。国家有关农村集体经营性建设用地的制度安排,刻画了包括形成制度和流转制度在内的制度变迁轨迹。从内在逻辑来看,形成制度和流转制度在交织互动下共同推动农村集体经营性建设用地制度向产权完善方向演进。其间,制度变迁呈现较强的路径依赖特征。从制度变迁动力来看,推动农村集体经营性建设用地制度变迁的动力由早期的政府主导切换到了市场主导,是市场在资源配置中主导地位显化的过程。据此,深化农村集体经营性建设用地入市改革应以节约集约利用土地资源为导向,以发挥市场在土地资源配置中的决定性作用为主逻辑,向集体土地产权完备和权能实现的方向推进。Rural collectively operated construction land was gradually separated from the earlier package of rural construction land management system.The evolution portrays the trajectory of institutional changes including the rural collective management construction land formation system and the transfer system.In terms of internal logic,the formation system and the transfer system jointly drive the evolution toward the perfection of property rights under the intertwined interaction.From the perspective of external forces,the external gradually switched from government-led in the early stage to market-led.During this period,the system evolution shows a strong path-dependent feature.Accordingly,We should next give practical play to the decisive role of the market in the allocation of land resources on the basis of land use control,and prudently and steadily promote the market entry of rural collective operating construction land.
