平台领域反垄断法律规制的效能提升策略

摘　　要：平台经济的兴起以其独特的商业模式重构资源配置方式和经济关系,给平台经营者带来巨大的经济权力。这种权力的集中和经济关系的转变,对传统反垄断法律规制模式的适用性提出了挑战。因此,迫切需要重构和调整法律关系,以适应并规制平台经济下的新型经济关系。当前,重构平台领域反垄断法律规制的趋势包括聚焦特殊平台主体、引入本身违法原则、提升规制效能。针对中国特有的国情和反垄断规制现状,需要平衡安全与发展,重构法律关系,并协同硬法与软法来提升治理效能,从而构建一个适合的平台领域反垄断规制框架。通过引入“守门人”制度和平台反垄断合规治理,统筹平台内外的规制路径,以提升中国平台领域反垄断法律规制的整体效能。The rise of the platform economy has reconfigured the resource allocation method and economic relations with its unique business model,and brought enormous economic power to platform operators.This concentration of power and transformation of economic relations has challenged the applicability of the traditional antitrust regulatory model.Therefore,there is an urgent need to reconstruct and innovate the legal relationship to adapt to and regulate the new type of economic relationship in the platform economy.At present,the trend of reconstructing antitrust legal regulation in the platform area includes focusing on special platform issues,introducing the principle of infringement,and improving the effectiveness of regulation.Given China’s unique national conditions and the current state of anti-monopoly regulation,it is necessary to balance security and development,reconstruct the legal relationship,and synergize hard and soft laws to enhance the effectiveness of regulation,so as to build an appropriate anti-monopoly regulatory framework in the platform area.The“gatekeeper”system and platform antitrust compliance governance are introduced,and the regulatory pathways inside and outside the platform are considered to enhance the overall effectiveness of China’s antitrust regulation in the platform area.
