摘  要:当今世界,专利对一个企业的重要性是不言而喻的。现代企业如果没有具有自主知识产权的产品将无法在市场上立足,更谈不上竞争优势。该文提出了一种系统化回避创新设计方法,旨在避开竞争对手的专利封锁,同时在现有专利基础上构思出新的专利而不侵犯别人的知识产权。该方法是将将现有专利各技术特征所实现的功能挖掘出来,在此基础上构思实现功能的其它载体,再将载体组合形成新的技术方案即新专利。文章重点阐述了该方法,并以实例证明了其有效性和通用性。此方法也可作为“互联网+”时代培养机械类学生创新能力的一种重要方法。In this world,the importance of patents to a company is self-evident.If a modern company does not have the product of its own intellectual property,it will not even stand out on the market,much less has competitive advantage.On how to avoid the patent blockage of the competitors and conceive new patent on the basis of the existing patent without infringing on the intellectual property of others,this paper presents an innovation design method of systematic avoidance.This method is to dig out the functions realized by the technical characteristics of the existing patents,and conceive other carriers to realize the functions,and then combine the carriers to form a new technical solution,namely a new patent.This method is emphasised in this paper,and then its effectiveness and versatility are also demonstrated by some examples.This method can also be used as an important method to cultivate the innovative ability of mechanical students in the“Internet+”era.
