摘 要:《著作权法》(2020)确立了作品类型开放主义。作品类型开放更能满足法律对不确定的现实及时作出反馈的需要。但面对个体拥有的无限创作空间与著作权法有限调整范围构成的窘境,以及为避免著作权的过度延伸、充分发挥其他规范的调解效用,表明作品类型完全放开既不可能,也无必要。比较而言,作品类型相对开放不但符合实际情况,而且具有可操作性。基于此,要筑起作品类型开放主义的二维限度。一方面,建构理论限度,以信息感知区分论作为尚未明确列举的作品形式能否纳入法定作品类型范围或设立新作品类型的标准。另一方面,凭借《著作权法》第三条,从其适用前提、适用原则、解释规则和适用细节四个角度,构筑作品类型开放主义的司法限度。The Copyright Act(2020)establishes an open doctrine of types of works.The openness of work genre better meets the need of the law to provide timely feedback to the uncertain reality.However,in the face of the dilemma posed by the unlimited creative space possessed by individuals and the limited scope of adjustment of copyright law,and in order to avoid the excessive extension of copyright and give full play to the mediation effect of other norms,it shows that it is neither possible nor necessary to completely liberalize the types of works.In comparison,the relative opening of work types not only meets the actual situation but also has operability.Based on this,the two-dimensional limits of work genre liberalism should be constructed.On the one hand,the theoretical limit is constructed,and the information perception distinction theory is used as the criterion for whether the forms of works not yet explicitly enumerated can be included in the scope of statutory work types or new work types are established.On the other hand,by virtue of Article 3 of the Copyright Law,the judicial limit of work type openness doctrine is constructed from four perspectives of its application premise,application principle,interpretation rule and application details.
