摘　　要：立足于“绿色航运”发展的时代背景与法治维度,从广义层面对“船舶垃圾”进行界定,概述船舶垃圾排放污染的现状,梳理涉及固体垃圾与液体废弃物处置以及船舶拆解垃圾处置的国际公约、国内法与规范性文件。围绕我国沿海海域船舶垃圾污染防治力度不足,船舶垃圾处置的相关规定缺乏可操作性与实践性,各国对拆船垃圾回收的重视程度差异性较大等法律问题,我国应全面参与联合国框架内海洋治理机制和相关规则的制定,充分重视航运领域的环境污染协作与共同治理,补充完善船舶垃圾排放监管的特殊规定,提升船舶垃圾处置相关规定的可操作性与实践性,落实拆船垃圾回收的统一适用标准与原则。Based on the background and legal dimension of the development of“green shipping”,this paper firstly defines the“ship garbage”from the general level,not only summarizing the status quo of ship garbage and emission pollution,but also combing through the international convention,domestic law and normative documents involving the disposal of solid wastes and liquid wastes as well as of the ship recycling garbage.Centering on such legal issues as the insufficient prevention and control for ship waste pollution in China’s coastal waters,the lack of operability and practicality in the relevant regulations for ship waste disposal,and the significant differences of attention for ship waste recycling between countries,China should entirely participate in the formulation of the governance mechanism and relative regulations within the frame of the United Nations,paying sufficient attention to both the environmental pollution coordination and joint governance in the field of shipping,supplementing and improving the special regulations for ship garbage discharge supervision,so as to promote the operability and practicality of relevant regulations for ship waste disposal,and to implement unified standards and principles for ship waste recycling.
