摘　　要：一致解释原则提出于中国重新加入世界贸易组织之际,其重要性随着国家间条约数量的增多以及条约所涉事项与国家利益紧密度的提高而日渐凸显,适用一致解释原则不仅能遵守条约必须信守的国际法原则、保证国内法与国际通行规则接轨,还能回应时代需求,发挥发展对外关系法的作用。但是在司法实践中,存在一致解释原则适用频率低且适用态度两极分化的情况,一致解释原则没有达到预期效果。这一适用困境主要体现在适用基础以及适用方法的不明确上。因此,为优化一致解释原则的适用,需针对问题进行改善。The principle of consistent interpretation was proposed when China rejoined the World Trade Organization,and its importance has become increasingly prominent with the rising number of treaties between States and the close relationship between the matters covered by the treaties and national interests.The application of the principle of consistent interpretation not only complies with the principles of international law that must be adhered to in the treaties and ensures that the domestic laws are in line with the internationally accepted rules,but also responds to the needs of the times and plays a role in the development of the law of foreign relations.However,in judicial practice,a low frequency of and a polarized attitude towards the application of the principle of consistent interpretation show the failure in achieving its expected effects.The dilemma is mainly reflected in the lack of clarity in the basis and the method of its application,which are supposed to be solved in order to optimize the application of the principle of consistent interpretation.
