高空抛物罪的理论辨正与实践检视

摘　　要：《刑法修正案(十一)》将高空抛物行为独立成罪,体现了立法者对市民“头顶安全”的高度重视。高空抛物独立成罪前,在司法适用过程中定性较为混乱,尚未形成统一的评价体系,高空抛物独立成罪有利于防止司法的恣意性,促进刑事司法处理高空抛物行为的体系化、统一化,实现罪刑均衡。然而高空抛物罪仍存在犯罪性质模糊、法益属性存疑、“情节严重”标准不明等问题。为实现法律适用的统一性,高空抛物罪应界定为具体危险犯,由于本罪的保护法益具有抽象化、精神化的特性,有必要重塑为公共安宁法益,以厘清“情节严重”的认定标准为基础,明确高空抛物罪与其他关联罪名的司法认定路径。The Eleventh Amendment to the Criminal Law independently criminalizes high-altitudethrowing behavior,which shows that legislators attach great importance to the"safety of citizens'heads".Before the independent criminalization of the high-altitude-throwing behavior,the determination of this behavior in judicial practice was relatively confusing,and no unified evaluation system had been established..The independent criminalization of the high-altitude-throwing behavior is conducive to preventing judicial arbitrariness,promoting the systematization and unification of criminal justice and keeping balance between crime and punishment in dealing with such behavior.However,there are still issues related with the high-altitude-throwing crime such as unclear criminal nature,questionable legal interest attributes,and unclear standards for"serious circumstances".In order to get uniformity in legal application,the high-altitude-throwing crime should be defined as a specific dangerous crime.Owing to the abstract and spiritual nature of the protection of legal interests in this crime,it is necessary to redefine it into a public security legal category.Based on the clarification of the criteria for determining"serious circumstances",it is necessary to clarify the judicial determination methodology and other related charges for the crime.
