从单一到联合:行贿人惩戒制度的演进与完善策略

摘　　要：2002年以来,行贿人惩戒制度走过初创、试点、推广、暂停和联合五个阶段。行贿黑名单制度与行贿犯罪档案查询制度都是对行贿人的惩戒制度,两者因制度要素不同导致惩戒效用有很大差异,行贿黑名单因其“大容量”和附带“检察建议”而更有反腐活力。国家监察体制改革后,全国联网的行贿犯罪档案查询系统暂停,而裁判文书网无法代替行贿黑名单的惩戒功能,与此同时各地对行贿人联合惩戒的实践探索仍在不断地进行着。为进一步完善行贿人惩戒制度,中央纪委国家监委应建立行贿人名单数据库,对录入范围进行扩容和分类;启用“监察建议”,对行贿人名单数据库的查询结果做强制性应用规范;建立合理的名单退出机制,给予悔过自新者重归社会的机会;完善行贿人名单数据库信息共享机制,确保查询信息的准确无误。Since 2002,the punishment system for bribers has gone through five stages:initiation,pilot,advancement,suspension and joint.Both bribery blacklist and the bribery crime archive query system are disciplinary measures for bribers,but their effectiveness differs greatly due to differences in institutional elements,the bribery blacklist system,with its more robust anti-corruption vitality due to its large capacity and accompanying prosecutorial recommendations,being more vigorous.After the reform of the national supervisory system,the nationwide networked bribery crime archive query system was suspended.However,the judicial document website cannot replace the disciplinary function of the bribery blacklist,joint punishment of bribers being explored into in various regions.For further completion of the punishment system,the Central Commission for Discipline Inspection and the National Supervisory Commission should establish a database of bribery lists to expand the scope of entries with classifications.The mandatory application standards of“supervision suggestions”should be implemented for querying results of the“bribery blacklist”database.A reasonable exit mechanism should be established.The information sharing mechanism of the“bribery blacklist”database should be improved with the joint punishment system for bribers to be perfected.
