论我国社会养老保险专门立法的必要性与可行性

摘　　要：社会养老保险是社会保障体系的重要组成部分,加强社会养老保险立法意义重大。加强社会养老保险专门立法是应对养老保险复杂性、长期性、风险性的需要,具有内在必然性。社会养老保险立法以现行法规文件为基础,以国际标准为参照,具有现实可行性。加强新时代社会养老保险立法的相关经济社会条件日趋成熟,实现依法治理具有现实紧迫性。各国高度重视社会养老保险立法,为我国社会养老保险立法提供经验借鉴。Social pension insurance is an important part of the social security system,so it is of great significance to strengthen the legislation of social pension insurance.It is necessary to strengthen the special legislation of social pension insurance to deal with the complexity,long-term and risk of pension insurance.The legislation of social pension insurance is based on current regulatory documents and referenced by international standards,which has practical feasibility.The relevant economic and social conditions for strengthening the legislation of social pension insurance in the new era are becoming increasingly mature,and it is urgent to achieve legal governance.All countries attach great importance to the legislation of social endowment insurance,which provides experience for the legislation of social endowment insurance in our country.
