家务劳动补偿制度的价值及其困境化解

摘　　要：为全面肯定家务劳动的价值,补偿隐藏在家务劳动背后的人力资本、机会成本的损失,进一步释放家务劳动补偿制度的活力,运用文献研究法和价值分析法,结合司法案例,总结出现行规范存在的制度困境,即家务劳动补偿标准和方式模糊,责任财产不明确,家务劳动纠纷举证责任过高。提出细化家务劳动补偿标准和方式、明确责任财产和优化家务劳动者的举证责任等更有助于细化该制度、推进该制度司法适用的困境化解方式。The compensation system of housework not only fully affirms the values of housework,but also compensates the loss of human capital and opportunity cost hidden behind the housework and further releases the vitality of the household labor compensation system.The paper,using such research methods as literature research and value analysis and based on judicial cases,summarizes the problems in the current norms as unclear housework compensation standards and modes,indefinite responsibility and property and excessive burden in the proof of housework disputes.To promote the judicial application of the system,it puts forward suggestions for the solution that include refining the compensation standards and modes of household work,clarifying the responsibility and property and optimizing the burden of proof of household work that will help refine the system and promote the judicial application of the system.
