摘　　要：智能制造、大数据时代、物联网在不断地推陈出新,新兴事物发展的速度之快加之法律本身的滞后性,使得市场开始出现黑暗之手操纵市场的行为。利用新技术、新方法、新领域使得犯罪手段“升级”是证券市场中竞争机制的天敌,亟须调整新型操纵证券市场行为的犯罪认定范畴。Intelligent manufacturing,the era of big data,the Internet of things in the continuous innovation set off waves of waves,the rapid development of new things coupled with the lag of the law itself,so that the market began to appear in the dark hand manipulation of the market behavior.The use of new technology,new methods and new fields to“upgrade”criminal means is the natural enemy of the com-petition mechanism in the securities market,and it is urgent to adjust the scope of the new manipulation of the securities market.
