收买被拐卖的妇女、儿童罪追诉时效困境及其破解

摘　　要：在打击收买被拐卖的妇女、儿童罪时,观念偏差、对刑法规范的误读、刑法追诉时效制度存在立法漏洞、该类案件自身特点等因素共同导致面临追诉时效困境。应加强法治宣传与纠偏,通过严格司法减少积案;收买者教唆他人拐卖妇女、儿童后卖给自己的,既构成收买被拐卖的妇女、儿童罪,也与拐卖者成立拐卖妇女、儿童罪的共犯,应数罪并罚;收买被拐卖的妇女、儿童行为是对亲情关系的破坏,是对亲属合法权益的侵害,被收买者的亲属亦是被害人;行为人实施收买行为后,又实施非法拘禁行为或拐骗儿童行为的,前罪追诉期限应该从非法拘禁行为或拐骗儿童行为终了后开始重新计算;在非法拘禁行为或拐骗儿童行为延续期内,收买行为的追诉时效当然不结束;基于社会稳定、子女抚养、个人意愿等因素,在“打拐”过程中应考虑当事人的情感变化。In the fight against the crime of buying trafficked women and children,the concept deviation,the misreading of the criminal law norms,the legislative loopholes in the statute of limitations of criminal law,and the characteristics of such cases lead to the dilemma of the statute of limitations of prosecution.To solve this di⁃lemma,this paper proposes the following solutions:We should strengthen the publicity of the rule of law and give play to its rectifying effect,and reduce the accumulation of cases through strict judicial procedures;Where a purchaser incites others to abduct and sell a woman or child to himself,he shall not only constitute the crime of buying an abducted woman or child,but also be an accomplice in the crime of abducting and selling a woman or child with the abductor,and shall be given a combined punishment for several crimes;The act of buying abducted women and children destroys the family relationship and infringes upon the legitimate rights and interests of the relatives,and therefore the relatives of the buyers are also the victims;If the perpetrator commits illegal detention or abduction of children after the purchase act,the time limit for prosecution of the previous crime shall be recalculated from the end of the illegal detention or abduction of children;During the period of illegal detention or abduction of children,the statute of limitations for prosecution of buying acts does not end;Based on social stability,child rearing,personal willingness and other factors,the emotional changes of the parties should be considered in the process of"combating trafficking".
