摘　　要：【目的】随着我国互联网技术的快速发展,网络图片创作形式越来越丰富,其侵权行为也日益增多。但目前监管网络图片的法律法规较少,相关研究也较少,因此有必要对网络图片侵权行为进行研究。【方法】通过分析我国网络图片侵权现状,结合其特殊性,提出保护网络图片版权人权利的现实法理措施。【结果】网络图片侵权方面存在市场信息不对称,版权交易受阻;批量诉讼多,商业化维权明显等问题。【结论】可以通过确定网络图片独创性立法标准、明确网络图片侵权案件赔偿数额、健全网络图片登记制度等措施完善我国网络图片著作权权利保护的法律法规。[Purposes]With the rapid development of Internet technology in China,the form of network image creation has become more and more abundant,and its infringement has also increased.However,there are few laws and regulations to supervise these network pictures,and there are few related studies.Therefore,it is necessary to study the infringement of network pictures.[Methods]By analyzing the current situation of network image infringement in China and combining with its particularity,this paper puts forward practical legal measures to protect the rights of network image copyright holders.[Findings]There are many problems in the infringement of network pictures in China,such as market information asymmetry,copyright transactions being blocked,mass litigation and too commercial rightssafeguarding.[Conclusions]It is suggested to improve the laws and regulations on the protection of copyright rights of online pictures in China by determining the legislative standards of originality of online pictures,clarifying the amount of compensation for infringement cases of online pictures and improving the registration system of online pictures.
