摘　　要：跨境电信网络诈骗犯罪已成为影响社会稳定的突出犯罪问题,海峡两岸更是跨境电信网络诈骗犯罪的重灾区。由于电信网络诈骗具有的“非接触性”和“信息化”特征,为逃避打击,近年诈骗集团将窝点由两岸向缅甸、柬埔寨、印尼、马来西亚、菲律宾、越南、老挝等东南亚第三地转移的趋势凸显。“信息化跨境犯罪”的发展导致传统的刑事管辖理论已经无法适应两岸跨境电信网络诈骗犯罪的惩治需要,两岸打击跨境电信网络诈骗犯罪面临很多新挑战,尤其是两岸跨境电信网络诈骗刑事管辖权冲突问题,亟需在增进互信的基础上加强司法合作与实践探索,为有序推进两岸关系和平发展提供保障。Cross-border telecom network fraud has become a prominent criminal problem that affects social stability,Both sides of the Taiwan Straits have become the hardest hit areas for cross-border telecom network fraud crime.Due to the“non-contact”and“informatization”characteristics of telecom network fraud,in order to avoid cracking down,the trend of fraud groups transferring their dens to third places such as Myanmar,Cambodia,Indonesia,Malaysia,the Philippines,Vietnam,Laos has become prominent in recent years,“crossborder crimes based informatization”has led to the traditional cross-Straitss criminal jurisdiction theory no longer being able to meet the punishment needs of cross-border telecom network fraud crime.Both Sides of the Taiwan Straits are facing many new challenges in combating cross-border telecom network fraud crime,especially regarding the conflict of criminal jurisdiction over cross-border telecom network fraud across the Taiwan Straits,Urgent need to strengthen judicial cooperation and practical exploration on the basis of enhancing mutual trust,To provide guarantees for the orderly promotion of peaceful development of crossStraits relations.
