中国式现代化进程中耕地保护制度的体系化

摘　　要：我国耕地保护的政策及法律制度较多且更新速度较为合理,但耕地保护的绩效并不理想。现有耕地保护制度数量多,但较为分散,没有产生耕地保护的制度合力。中国式现代化的实现需要体系化的耕地保护制度,体系化的耕地保护制度与中国式现代化的实现具有内在逻辑关系。当前,耕地保护制度体系化面临一系列问题,如耕地数量保护制度厚度不足、耕地质量保护制度呈现碎片化、耕地保护储备制度较为分散、耕地生态补偿制度不够规范及耕地保护救济制度力度不足等。因此,要明确耕地保护制度的体系化思维,以土地当量制度推进耕地质量与数量保护制度的落地,以构建体系化的耕地保护储备制度和耕地生态补偿制度为抓手,以耕地保护救济制度的体系化为突破点,在中国式现代化的历史进程中实现耕地保护绩效提升。There are many policies and legal systems for farmland protection in China and the updating speed is relatively reasonable,but the performance of farmland protection is not ideal.The existing cultivated land protection systems,although numerous,are relatively scattered,and do not generate institutional synergy for cultivated land protection.The realization of Chinese-style modernization requires a systematic cultivated land protection system,which has an internal logical relationship with the realization of Chinese-style modernization.The systematization of cultivated land protection system faces practical problems such as insufficient thickness of cultivated land quantity protection system,fragmentation of cultivated land quality protection system,relatively scattered cultivated land protection and reserve system,insufficient standardization of cultivated land ecological compensation system,and insufficient strength of cultivated land protection and relief system.In view of this,it is necessary to clarify the systematic thinking of the cultivated land protection system,promote the implementation of the cultivated land quality and quantity protection system with the land equivalent system,build a systematic cultivated land protection reserve system and ecological compensation system for cultivated land,and take the systematization of the cultivated land protection relief system as a breakthrough point to realize the conservative innovation of improving the performance of cultivated land protection in the historical process of Chinese-style modernization.
