摘　　要：《保护非物质文化遗产公约》自2003年通过至今已有20年,作为一项由政府主导,社会参与的文化治理工作,对非物质文化遗产的保护既能促进文化多样性,也能在实践操作层面维护生物多样性,从而助力人类社会的可持续发展。非遗保护涉及领域广泛,动物使用在其中也有十分重要的作用,但在保护非遗的过程中,动物伦理成为不可忽视的一大难题。然而,在以法律为代表的各级各类政策中,在非遗保护实践与动物伦理关切之间未能实现协合增效,彼此间的张力直接影响人们对非遗传承的认识。鉴于联合国教科文组织努力弥合国际法间的分立状态,中国在非遗保护领域和动物保护领域的立法实践及其未来走向必然以协同对接为准则。It has been 20 years since the UNESCO's 2003 Convention on the Safeguarding of the Intangible Cultural Heritage was passed.As a cultural governance project led by the government and involving the social participation,the safeguarding of intangible cultural heritage can not only promote cultural diversity,but also maintain biodiversity at the practical level,thereby contributing to the sustainable development of human society.The safeguarding of intangible cultural heritage involves a wide range of fields,and the use of animals also plays a crucial role.However,in the process of safeguarding intangible cultural heritage,animal ethics has become a major challenge that cannot be ignored.However,among various policies at all levels represented by the law,there has been a lack of synergy between the protection practices of intangible cultural heritage and concerns over animal ethics,and the tension between them directly affects the people's understanding of the inheritance of intangible cultural heritage.Given the efforts of UNESCO to bridge the gap between international laws,Chinese legislative practice and future direction in the field of intangible cultural heritage protection and animal protection will inevitably be guided by collaboration and integration.
