摘　　要：本文探讨了“三权分置”实施背景下农村宅基地产权认知的代际差异,从代际差异角度剖析两代农民对宅基地带来的公共利益与宅基地衍生的私人收益的界定。分析了两代农民对“三权分置”的态度、认知、及对宅基地是否私有所存在的一些担忧,并厘清两代农民对宅基地今后的产权的认知差异。通过对崇信县木林乡9个行政村随机发放问卷的统计分析发现:(1)农民对宅基地产权的代际差异明显;(2)宅基地产权认知的代际差异受到文化程度和家庭年收入的影响;(3)只有现代农民随着个人特征的变化对宅基地产权和处置权的认知与现行法律规定保持一致性外,传统农民和现代农民对宅基地抵押权和继承权方面的认知均有较大差异。最后,应该加大对农村地区宅基地产权政策的宣传力度,提高农民的宅基地产权认知能力。This paper explores the intergenerational differences in farmers'perceptions of property rights of residential bases in the context of the implementation of the"separation of three rights",and analyzes the definition of public benefits and private benefits derived from residential bases from the perspective of intergenerational differences between the two generations of farmers.It also analyzes the attitudes of the two generations of farmers toward the"three rights of ownership",their perceptions,and concerns about whether the homestead is privately owned,and clarifies the differences in the perceptions of the two generations of farmers about the future ownership of the homestead.Through statistical analysis of questionnaires randomly distributed to nine administrative villages in Mulin Township of Chongxin County,it was found that:(1)intergenerational differences in farmers'perceptions of home base property rights were obvious;(2)intergenerational differences in the perceptions of home base property rights were influenced by literacy and annual household income;(3)only the modern farmers'perceptions of the property rights and disposal rights of the house bases with the changes of their personal characteristics are consistent with the current laws,but the perceptions of traditional farmers and modern farmers on the mortgage rights and inheritance rights of the house bases are different.Finally,we should increase the publicity of the policy of home base property rights in rural areas to improve farmers'cognitive ability of home base property rights.
