摘 要:目的 通过梳理抗新型冠状病毒复制创新药氢溴酸氘瑞米德韦(VV116)的研发历程和全球专利布局情况,明确其核心技术创新路径和专利保护策略,为我国创新药物的研发和关键核心技术的专利挖掘与布局提供借鉴。方法 在专利数据库和期刊数据库中全面检索VV116专利申请、授权情况,并进行文献统计和实证分析。结果 VV116采用氘代策略成功突破国外原研药的专利壁垒,并在短时间内围绕其核心化合物的产品、用途、制备方法、晶型多个方面完成了高价值专利组合物构建,还通过专利合作条约(Patent Cooperation Treaty, PCT)途径在全球10余个国家构筑了海外专利保护网。结论 VV116成功研发体现了我国创新药企及科研院所在新型冠状病毒防治药物上的高水平创造和高质量保护,对推动国内创新药研发的知识产权保护具有积极意义。Objective To identify the core technology innovation path and patent protection strategy, and provide reference for the research and development of innovative drugs in China and the patent mining and layout of key technologies, the research and development process and global patent layout of the innovative drug of antiSARS-CoV-2 replication, deuteriomevir hydrobromide(VV116) were sorted out.Methods VV116 patent applications and authorizations were searched in patent databases and journal databases, comprehensively, and methods of literature statistics and empirical analysis were also used.Results Through the deuterium substitution strategy, the patent barriers of foreign original research drugs about VV116 were broke through successfully, the construction of high-value patent compositions around its core compound products, uses, preparation methods, crystal forms were completed in a short period, and overseas patent protection networks were established in more than 10 countries worldwide through the PCT pathway.Conclusion The high level of innovation and high-quality protection of SARS-CoV-2 preventive drugs by innovative pharmaceutical enterprises and research institutes are reflected by the successful research and development of VV116 in China, which is of positive significance for promoting intellectual property protection of innovative drug research and development in China.
