晚清修律与男性话语书写——以修订新刑律草案中夫妻法律关系演变为例  

Law Revision and Male Discourse Writing in Late Qing Dynasty——A Case Study of the Evolution of the Legal Conjugal Relation in the New Revised Draft Criminal Code

摘　　要：从性别视角来看,清末修订新刑律是男性话语书写的法律改革。以夫妻法律关系演变为例,夫为妻纲是中国古代夫妻法律关系形成的基础性原则。清末新刑律草案以模范列强为宗旨,废除夫为妻纲,引入夫妻平等理念。在修律过程中,礼、法双方分别从家族主义进路和国家主义进路就夫妻平等展开激烈的争论,争论的本质是双方对妇女归属权的争夺。男性话语书写下的夫妻平等带有强烈的国家主义烙印,女性处于被动的他者地位。从传统律典中妇女处于蒙昧、需要被教导的状态,到新刑律草案中妇女处于需要被改造的状态,妇女在摆脱家族主义的桎梏之后,又进入国家主义的牢笼之中。From the perspective of gender,the revision of the new criminal code in the late Qing Dynasty was a legal reform of male discourse writing.Taking the evolution of the legal conjugal relation as an example,a wife obeying a husband is the basic principle of the conjugal relation in ancient China.The new draft criminal code at the end of the Qing Dynasty was intended to imitate great powers,abolishing the principle of a wife obeying a husband and introducing the concept of equality between husband and wife.In the process of law revision,the two sides of people propriety rituality and people stressing regulations launched a fierce argument on the equality of husband and wife from the aspect of familism and nationalism,and the essence of the argument was the struggle for women's ownership rights.The husband-and-wife equality under the male discourse has a deep brand of nationalism,and women are in a passive position of otherness.From the opinion that women are ignorant and need to be taught in the traditional law to the idea that women need to be reformed in accordance with the new draft criminal code,women enter the cage of nationalism after getting rid of the shackles of familism.
