摘　　要：《中华人民共和国船舶油污损害民事责任保险实施办法》(以下简称《办法》)于2010年10月1日起施行,为我国履行《1992年国际油污损害民事责任公约》和《2001年国际燃油污染损害民事责任公约》提供了国内法依据,也为我国海洋环境保护提供了保障,但《办法》存在编写体例混乱、规定不够具体、与公约规定不一致等问题。通过梳理现行《办法》中存在的问题并提出相关修改建议,以供参考。Measures for the Implementation of Insurance on Civil Liability for Oil Pollution Damage of Ships in People's Republic of China(hereinafter referred to as"the Measures")implemented since October 1,2010 provides domestic legal basis for the implementation of International Convention on Civil Liability for Oil Pollution Damage,1992 and International Convention on Civil Liability for Bunker Oil Pollution Damage,2001 and provides guarantee for marine environment protection.However,there are also some problems with the"Measures",such as confusion in compilation style,provisions which are not specific enough,and inconsistency with the provisions of relevant conventions.This paper analyze the existing problems of the"Measures"and proposes relevant suggestions on the modification.
