网络时代社会治理迭代升级与犯罪控制协同化的刑事政策

摘　　要：如何因应网络时代的犯罪态势与典型特征对我国宽严相济等刑事政策进行更新和调整,建构与之动态适应的协同化刑事政策,是当下我国刑事治理领域面临的难题。网络时代社会结构升级以技术驱动为推进力量,技术及其风险贯穿社会治理全过程,协同化刑事政策应遵循相对主义犯罪观,重点关注保障公民基本权利、引入社科法学思维、控制技术创新行为出入罪等议题。刑事政策的协同化不是平行多轨的同步化,而是在消极预防性刑法理念基础上的网络时代的社会治理与刑事政策、适应时代性的刑事政策与刑法体系的融通。网络时代的刑事政策是一种以宽严相济为基础的“社会治理迭代升级与犯罪控制协同化”的刑事政策,其动态调整过程是“社会治理的演进”与“刑事政策的演进”的双向互动过程,也是刑法体系与刑事政策协同演进的过程,协同化方案体现为对刑法理念、立法和司法的全方位调适。As the Internet is deeply embedded in the field of social governance,it continues to promote the iterative up⁃grading of social governance concepts and methods,which is concentrated in the network,intelligence and linkage of social governance system supported by information technology,which has a great impact on the positive criminal policy based on traditional crime,with the goal of crime prevention and security.Traditional criminal policies,such as tempering justice with mercy,source governance,and strict but not severe,face many practical difficulties in the governance of cybercrime.It is urgent to update and adjust the criminal situation and typical characteristics in the network era,and construct a coordinated criminal policy that dynamically adapts to it.The upgrading of social struc⁃ture in the Internet era is driven by technology.Technology and its risks run through the whole process of social go⁃vernance.Collaborative criminal policy should follow the concept of relativism crime,with the goal of regulating risk,controlling crime rather than eliminating risk,and eradicating crime.It focuses on the protection of citizens’basic rights,the introduction of social science and law thinking,and the control of innovative behavior in and out of crime.The coordination of criminal policy is not the synchronization of parallel multi-tracks,but the integration of social governance and criminal policy in the Internet era based on the concept of negative preventive criminal law,and the integration of criminal policy and criminal law system adapted to the times.The criminal policy in the network era is a kind of criminal policy of“iterative upgrading of social governance and coordination of crime control.”Its dyna⁃mic adjustment process is a two-way interactive process of“evolution of social governance”and“evolution of crimi⁃nal policy,”and it is also a process of coordinated evolution of criminal law system and criminal policy.The coordi⁃nation scheme is embodied in the all-round adjustment of
