摘　　要：注意义务遵照以知道命题为基础的归责体系,不应超出知道的意志条件,应当知道的前提是能够知道。法益侵害的事实性逻辑推导出法益保护的扩张性理解,其证成可依托于三个有益视角:其一,权利价值本位下,算法塑造网络空间治理结构的私权力,倒逼个体权利扩张;其二,当权利与义务呈现恶性消减的守恒,义务扩张即为以表象为基础的信任模式下遵循权责一致原则的体现;其三,动态系统论对全有全无桎梏的突破,为义务扩张创设制度空间。着眼于利益衡平精神的实质要求,从司法示范、产业实践与平台自治角度着手,在权责转换中兼顾与既有规则的适配,能够有效避免法律体系内部的掣肘与冲突,实现对版权生态的合理规制和对本国产业的正向激励。The duty of care follows a system of attribution based on the proposition of knowledge,which should not go beyond the volitional condition of knowledge,and should be known on the premise of being able to know.The factual logic of legal infringement infers an expansive understanding of legal protection,the proof of which can be based on three useful perspectives:first,under the value of rights,the algorithm shapes the private power of the governance structure of cyberspace,forcing the expansion of individual rights.Second,when rights and obligations show a viciously diminishing conservation,the expansion of obligations is a manifestation of the principle of consistency of rights and responsibilities under the representation-based trust model.Thirdly,the breakthrough of dynamic system theory to the all-or-nothing shackle creates institutional space for the expansion of obligations.Focusing on the substantive requirements of the spirit of balance of interests,starting from the perspective of judicial demonstration,industrial practice and platform autonomy,and taking into account the adaptability to the existing rules in the conversion of rights and responsibilities,it is possible to effectively avoid the constraints and conflicts within the legal system,and realize the reasonable regulation of the copyright ecosystem and positive incentives for the domestic industry.
