摘　　要：通过实证分析《关于办理黑恶势力刑事案件中财产处置若干问题的意见》发布后黑恶势力犯罪中财产处置的情况,发现财产处置的被重视程度和规范程度都得到普遍提高,同时相应难点问题的争议也在不断升级。究其原因,黑恶势力犯罪的复杂性是财产处置的根本难点,涉案财产的复杂性是直接难点,处置措施之间的模糊关系是财产处置的理论难点。2021年《反有组织犯罪法》应运而生,专章规定涉案财产的认定与处置,其吸收了扫黑除恶中的具体经验,对涉案财产认定处置制度有了新的发展,但是仍有遗憾。因此,在实践中公检法部门有必要树立“人-财-罪”过程性思维,时刻关注涉案财产的法律性质并厘清其与处置措施间的对应关系。Through empirical analysis of the situation of property disposal in crimes of underworld forces after the promulgation of the Opinions on Several Issues Concerning the Handling of Cri min al Cases of Underworld Forces,it is found that the degree of attention and standardization of property disposal has been generally improved,and the corresponding difficult problems controversy is also escalating.The complexity of the crimes of the underworld forces is the fundamental difficulty,the complexity of the property involved is the direct difficulty,and the vague relationship between the disposal measures is the theoretical difficulty.The Anti-Organized Crime Law was promulgated in 2021.Chapter 4 stipulates the identification and disposal of the property involved in the case.It has absorbed judicial experience and has made new developments in the system,but there are still regrets.In practice,it is necessary for the public security procuratorate and courts to establish a process thinking of “person-property-crime”,and to clarify the legal nature of the property involved and the corresponding relationship between the disposal measures.
