网约车“一元”立法体例构建——基于司法实践的实证分析

摘　　要：近年来,随着“互联网+”的快速推进,我国数字经济成绩斐然。其中,以移动网络和大数据等新技术为基础,整合社会资源为消费者提供便利服务的共享经济异军突起,网约车也给人们带来了诸多便利。然而,目前针对出租汽车的“二元”立法体例在规制网约车过程中尚存有不足。其具体表现为:不能适应网约车、巡游车趋同发展现实,法律适用受到“二元”规制阻隔等问题。文章通过实证分析网约车法律规制的静态文本现状、动态的规则适用,从“二元”规制的区分标准、法律规制主体设计方面探究了“二元”立法体例的局限,进而提出了从框架设计、增加营运管理责任条款、弱化地方区域性约束条款等方面构建“一元”立法体例,以期实现良法善治,回应经济社会发展需求,持续优化网约车的市场环境的具体建议。In recent years,with the rapid advancement of“Internet plus”,China's digital economy has made remarkable headway.Among them,the sharing economy,which provides convenient services for consumers through integrating social resources by means of emerging technologies such as mobile networks and big data,has risen.Among which the ride hailing services have also brought great conveniences to people.However,the current binary legislative framework is insufficient for regulating ride hailing services.Its specific manifestation is that it cannot adapt to the synegistic development of ride hailing and touring vehicles,and the application of laws is hindered by binary regulations.To this end,the article aims to expound the static text and dynamic rule application of the legal regulation of ride hailing services,explores the limitations of the binary legislative framework in terms of the differentiation standards and the design of legal regulatory subjects,and further proposes to construct a unified legislative framework from the aspects of framework design,adding operational management responsibility clauses,weakening the regulation of regional constraint clauses,responding to the trends of economic and social development and continuously optimizing the market environment for ride hailing services,so as to achieve the rul e of good law and good governance of law.
