行政诉讼异地交叉管辖背景下的检察一体化研究

摘　　要：行政诉讼异地交叉管辖是减少地方干预、强化司法权对行政权监督的有效举措,该制度的实施为行政诉讼检察监督工作带来了新挑战,也面临调查取证难、行政违法行为监督效果难以发挥、行政争议实质性化解难以实现等问题。文章以检察一体化履职为思路,提出通过检察机关上下一体整合力量、同级检察机关横向联合、建立信息化平台实现内部协同的方式,有效化解行政监督案件办理中的困境,实现以“穿透式”监督助力法治政府建设的目标。Cross-jurisdiction of administrative litigation in different places is an effective measure to reduce local intervention and strengthen the supervision of judicial power over administrative power.The implementation of this system has brought new challenges to the procuratorial supervision of administrative litigation,making it difficult to investigate and obtain evidence,to exert the supervision effect of administrative illegal acts,and to realize the substantive resolution of administrative disputes.Based on the idea of integrated performance of procuratorial duties,this paper puts forward the ways of integrating the strength of procuratorial organs from top to bottom,horizontal combination of procuratorial organs at the same level,and establishing information platform to achieve internal coordination,so as to effectively resolve the difficulties in handling administrative supervision cases and achieve the goal of penetrating supervision to help build a government ruled by law.
