论假劣种子的行政和司法认定标准及衔接

摘　　要：种子是农业的“芯片”,打击假冒伪劣种子是保障种子质量安全,强化品种权保护的重要举措。《种子法》和《刑法》分别规定了假劣种子的行政认定标准和司法认定标准,基于行政不法和刑事不法的性质差异,二者在内涵上并非一一对应的关系。通过对行政认定标准和司法认定标准性质、特点和适用的分析,立足司法认定标准的相对独立性,厘清假劣种子行政案件的司法移送标准,畅通行刑衔接渠道。Seed is the'chip'of agriculture.Cracking down on fake and shoddy seeds is an important measure to guarantee seed quality and safety and strengthen the protection of variety rights.'Seed Law of the People's Republic of China'and'Criminal Law of the People's Republic of China'respectively stipulate the administrative and judicial standards of false and bad seeds,because of the difference in the nature of administrative illegal and criminal illegal,the connotation of the two are not one-to-one correspondence.Through the analysis of the nature,characteristics and application of the administrative identification standards and judicial identification standards,based on the relative independence of judicial identification standards,the judicial transfer standards of false and bad seed administrative cases were clarified,and the connecting channels of execution were smooth.
