地方人大及其常委会监督地方监察机关的法治逻辑及展开路径

摘　　要：地方人大及其常委会监督地方监察机关具有严密的法治逻辑,既是人民代表大会制度的内在逻辑要求,也是强化对权力运行制约和监督的必然要求,还是对监督者再监督的题中之义。但由于监察权在我国新“四权”权力配置模式中处于优越地位,地方人大及其常委会监督地方监察机关还面临一些挑战和障碍。这就需要在正确认识和处理地方人大及其常委会监督与地方监察机关监察两者“异中有同”“相得益彰”关系的基础上,由地方人大及其常委会对地方监察机关开展“正确监督、有效监督、依法监督”,以实现地方人大及其常委会对地方监察机关监督的目的。Local People's Congress and its standing committee(LPCSC)supervise local supervision organs have a strict logic of the rule of law,which is the inherent logical requirement of the peoples congress system,and the inevitable requirement of strengthening the constraints on and supervision of the operation of power,and the meaning of the topic of re-supervision of supervisors.However,due to the advantageous position of supervisory power in the new“four power”allocation model in China.LPCSC still face some challenges and obstades in supervising local supervisory organs.Therefore,on the basis of correctly understanding and han-dling the relationship between the supervision of LPCSC and the supervision of local supervision organs,which are“different but similar”and“mutually complementary”,the LPCSC shall carry out“correct,effective,and legal supervision”over local supervision organs,so as to achieve the purpose of LPCSC in supervising local su-pervision organs.
