摘  要:医院法律顾问制度是现代医院管理制度在法治领域的具体表现,已逐渐成为现代医院建立健全自身运行风险防控与化解机制的重要组成部分。医院推行法律顾问制度更是坚持和完善现代医院管理制度,推进医院治理体系和治理能力现代化的有效途径之一。文章从医院、法律顾问、制度执行和相关配套机制建设等角度探析法律顾问制度在医院的推行情况,认为法律顾问制度能在医院发展中提供专业、长效的法律保障服务,促使医院依法管理和依法行医的能力与水平逐步提升,并在一定程度上规避行业风险,减少经济损失。与此同时,由于制度执行力有待加强、医院职工法律意识薄弱、医疗行业的法务工作专业综合性强、制度的组织领导及其相关配套机制未完善等问题,法律顾问制度的优势作用在现代医院发展中还未充分发挥。因此,在下一步的制度推行中,应从加强组织领导、优化法治服务、人才培养与激励、建立健全相关组织机构与工作协调机制等方面进行改善。The hospital legal consultant system is a concrete manifestation of the modern hospital management system in the legal aspect and has gradually become an important part of risk prevention and resolution mechanism in the modern hospitals;the implementation of the legal consultant system is an effective method to uphold and improve the modern hospital management system and promote the modernization of hospital governance system and capabilities.This article examines the implementation of the legal consultant system from the perspectives of hospitals,legal consultants,system implementation and the construction of related supporting mechanism.This article argues that the legal consultant system can provide professional and long-term legal protection in the development of hospitals,promote the capabilities of lawful management and practice of medicine of the hospitals,and prevent the industry risks and decrease the economic loss to a certain extent.At the same time,due to issues such as the poor implementation of the system,the weak legal awareness of hospital employees,the comprehensiveness of medical law,and the imperfect organization and leadership of the system and related supporting mechanisms,the strength of the legal consultant system has not been fully utilized.Therefore,in the next step of the implementation of the system,improvements should be made in terms of strengthening organizational leadership,optimizing legal services,talent training and incentives,and establishing and improving relevant organizational structures and coordination mechanisms.
