农村“微腐败”的类型、特征、成因与治理——基于对184份法院判决书的分析

摘　　要：“微腐败”是妨碍乡村全面振兴的重要因素。农村“微腐败”发生领域相对集中,主要体现在征地拆迁、精准扶贫、村级公共资金、国家专项补贴、救济救助、乡村小型工程等领域,具有鲜明的阶段性特征。农村“微腐败”主要表现为乡村干部“一把手”成为主要涉案群体,涉案金额普遍不大,单个乡村干部涉案金额相对较小,案发领域相对集中,公共资金成为主要侵害对象,腐败手段相对单一,共同作案是主要腐败形式,涉案罪名相对集中,涉案处罚相对较轻,等等。农村“微腐败”发生的原因主要为基层党组织管党治党不力,基层党政职能部门监督不严,财务管理制度存在明显缺陷,防止利益冲突制度不健全,乡村干部待遇偏低,等等。治理农村“微腐败”,要从完善乡村管党治党制度体系、提升管党治党能力入手,一体推进“不敢腐、不能腐、不想腐”,实现三者同时发力、同向发力、综合发力,全面提升防治腐败的整体效能。具体地说,就是保持严惩腐败的高压态势,强化“不敢腐”;创新基层治理,健全“不能腐”的制度体系;加强教育管理,增强“不想腐”的政治自觉。Micro corruption is an important factor that hinders the compre hensive revitalization of rural areas.The area where rural“micro corruption”occurs are relatively concentrated,mainly reflected in land acquisition and demolition,targeted poverty alleviation,village level public funds,national special subsidies,relief and assistance,and small rural projects,with distinctive phased characteristics.Rural“micro corruption”has distinct characteristics,mainly manifested as rural cadres becoming the main group involved in cases,with relatively low amounts of money involved.Individual rural cadres have relatively small amounts of money involved,with relatively concentrated areas of involvement.Public funds have become the main target of infringement,and the means of corruption are relatively single.Jointly committing crimes is the main Corruption form,with relatively concentrated charges involved and relatively light punishment results.The main reasons for the occurrence of rural“micro corruption”are the inadequate management and governance of grassroots party organizations,lax supervision by grassroots party and government functional departments,obvious defects in fi nancial management systems,inadequate systems for preventing conflicts of interest,and low treatment of rural cadres.To address rural“micro corruption”,we need to start with improving the system of rural party management and enhancing the ability to manage and govern the party.We should promote the unity of not daring to corrupt,can not corrupt,not wanting to corrupt,and achieve the simultaneous,simultaneous,and comprehensive efforts of the three,comprehensively improving the overall effectiveness of preventing and controlling corruption.To be specifi c,we will maintain a high-pressure situation by severely punishing corruption and strengthening the fear of corruption.innovate grassroots governance and improve the institutional system that cannot be corrupted,strengthen education and management,and enhance the awareness of not wanting to corru
