监察与司法衔接中法官惩戒制度的调适路径

摘　　要：国家监察体制改革和司法体制综合配套改革均是我国政治体制改革的重要组成部分。国家监察体制改革产生了全新的监督格局,法官被纳入监察对象,这对基于深化司法体制综合配套改革的法官惩戒制度再造产生了重大的影响。监察全面覆盖背景下要求对包括法官在内的公职人员在制度设计、制度运行方面加以考量。而深化司法体制综合配套改革背景下法官惩戒制度具有维持审判独立、审判自律和实现专业追责等功能,法官惩戒制度的存在具有独特的价值和意义。因此,在深化国家监察体制改革和司法体制综合配套改革双重背景下,应当明确监察机关、人民法院、法官惩戒委员会在法官惩戒制度中的定位,完善监察机关和法官惩戒机构重合管辖事项的具体机制,持续深化法官惩戒委员会由鉴定主体向惩戒主体转变的改革。此外,在双重体制改革下,监察机关对法官行使监察权应当遵循基本司法规律,同时,法官惩戒制度在双重体制改革中应当面向监察全面覆盖和审判专业判断的双向融合,以实现监察与司法的衔接协调。The reform of the national supervisory system and the comprehensive reform of the judicial supporting system are both important components of China’s political system reform.The reform of the national supervisory system has led to a new pattern of supervision,where judges are included as objects of supervision,which has a significant impact on the reconstruction of the judge disciplinary system based on the deepening of the comprehensive reform of the judicial system.Under the background of comprehensive coverage of supervision,it is necessary to consider public offi cials,including judges,in system design and operation.Under thebackground of deepening the comprehensive reform of the judicial system,the judge disciplinarysystem has the functions of maintaining judicial independence,self-discipline,and professional accountability,and the existence of the judge disciplinary system has unique value and signifi cance.Therefore,under the dual background of deepening the reform of the national supervisory system and the comprehensive reform of the judicial system,it is necessary to clarify the positioning of the supervisory organs,people’s courts,and judge disciplinary committees in the judge disciplinary system;improve the specifi c mechanisms based on the overlapping jurisdictional matters between supervisory organs and judge disciplinary institutions;and continue to deepen the reform of Judge;Disciplinary Committee from the subject of appraisal to the subject of punishmont.In addition,under the dual system reform,supervisory organs’exercise of supervisory power over judges should follow the basic principles of the judiciary,at the same time,the judge disciplinary system should be oriented towards the dual integration of comprehensive coverage of supervision and professional judgment of trials to achieve the coordination andconnection of supervision and justice.
