摘　　要：“首违不罚”制度在海事执法领域属于新生事物,如果在执法过程中不能准确把握,可能会造成“执法不严”“随意执法”“执法不作为”等情形。通过分析海事行政执法实践中遇到的问题,提出制度优化的建议,优化执法方式,确保相关举措落地。The rule of "no punishment to first violation" is a novelty in the field of maritime law enforcement.Without proper implementation during the law enforcement process,it may lead to situations such as "indifferent law enforcement","arbitrary law enforcement",and "law enforcement inaction".Through analyzing the problems encountered in maritime administrative law enforcement practice,the paper proposes suggestions on optimizing the regulations and the law enforcement methods in order to ensure the proper implementation of relevant measures.
