摘　　要：中药品种保护制度是政府对特定领域经济活动进行适当干预和管理、具有中国特色、体现中药特点的法律制度,2022年12月《中药品种保护条例(修订草案征求意见稿)》中提出了中药品种市场独占保护的制度设计,符合中医药创新规律,具有历史必然性和合理调控市场的公允性。要正确认识中药的创新规律,才能正确评价制度本身的必要性与合理性。中药品种的质量提升是一个扬弃过程,必须把握守正与创新规律,肯定和鼓励每一个进步。中药产业的创新能力是现代企业市场竞争的基础,市场管理需要有针对性、有效性的市场激励政策。正视中药企业对营商环境的法律需求,确立市场独占保护机制,更有利于企业参与国内外市场竞争。The TCM products protection system is a socialist legal system with Chinese characteristics for the government intervention and management on economic activities in specific fields.In December 2022,the“Regulations on Protection of Traditional Chinese Medicinal Products(Revised Draft for Soliciting Opinions)”proposed the institutional design of the exclusive protection for TCM products,which conforms to the innovative laws of TCM,has historical inevitability and fairness for regulating the market rationally.Only by correctly understanding the innovative laws of TCM can the necessity and rationality of the system itself be correctly evaluated.Improving the quality of TCM products is an abandoning process.The rules on cultural inheritance and innovation should be followed,every progress must be affirmed and encouraged.The innovation capability of the TCM industry is the foundation of modern enterprise market competition.Market management requires targeted and effective market incentive policies.Confronting the legal needs of TCM enterprises for business environment and establishing an exclusive protection mechanism are conducive for enterprises to participate in domestic and international market competition.The content of this article only represents the author's viewpoint and does not represent the author's unit's viewpoint or position.
