摘　　要：地方生态环境立法是生态环境法律制度体系的重要部分,是国家层面生态环境立法向基层的重要延伸,也是国家法律在地方有效实施的重要支撑。在习近平新时代中国特色社会主义思想特别是习近平生态文明思想、习近平法治思想的引领下,各地坚持用最严格的制度、最严密的法治保护生态环境,地方生态环境立法取得丰硕成果,地方生态环境立法的要素、门类越来越丰富。各地在生态环境领域法律制度建设上作了一些有益探索,包括区域协同立法、生态环境综合性主题立法、践行全过程人民民主等,并在坚持不抵触原则下聚焦突出问题,作了不少制度创新,成为法律、行政法规先行先试的经验来源。总结和梳理地方生态环境立法的实践、创新和经验,对推动完善国家层面立法,在国家层面编纂一部生态环境法典,统领包括生态环境地方性法规在内的生态环境领域法律体系建设,完善生态环境法律制度,形成推动生态文明建设的强大合力,具有重要意义。Local ecological and environmental legislation is an important part of the ecological and environmental legal system,an important extension of national-level ecological and environmental legislation to the grass-roots level,and an important support for the effective implementation of national laws at the local level.Led by Xi Jinping's thought on socialism with Chinese characteristics for a new era,especially Xi Jinping's thought on ecological civilization and Xi Jinping's thought on the rule of law,localities have insisted on protecting the ecological environment with the strictest system and the tightest rule of law,and have made fruitful achievements in local ecological environmental legislation,which is becoming richer and richer in terms of elements and categories.Localities have made some useful explorations in the construction of legal systems in the field of ecological environment,including regional coordinated legislation,comprehensive thematic legislation on ecological environment,practicing people's democracy in the whole process,etc.Localities have also focused on the outstanding issues under the principle of non-contradiction,and have made a lot of institutional innovations,which have become a source of experience for the advancement of laws and administrative regulations.Summarizing and sorting out the practices,innovations and experiences of local ecological and environmental legislation is of great significance in promoting the improvement of legislation at the national level,compiling an ecological and environmental code at the national level,leading the construction of a legal system in the field of ecology and environment,including local ecological and environmental regulations,and perfecting the ecological and environmental legal system to form a strong synergy for the promotion of the construction of an ecological and civilized society.
